Booking Terms & Conditions

These Booking Terms & Conditions apply across Landmark group trips, private trips, custom itineraries, add-ons, and direct or online bookings.

Introduction

Please read these Booking Terms & Conditions carefully. They form an important part of the contract for your trip or travel experience with Landmark. Do not make a booking unless you understand and agree to these terms. By making a booking, paying a deposit, completing a booking form, accepting a proposal, or participating in a Landmark trip, you confirm that you understand and agree to these Booking Terms & Conditions.

These terms apply to bookings made directly with Landmark, through a Landmark trip dashboard or reservation portal, through Landmark's website, through payment links, by invoice, or through any authorised Landmark representative. If your trip-specific booking page, invoice, contract, or proposal includes terms that are different from these general terms, the trip-specific terms will apply to the extent of the difference.

1. Your Booking and Contract With Landmark

All experiences are organised, curated, coordinated, or offered for sale by SetUp Event Rentals Limited, trading as Landmark. References to “Landmark”, “we”, “us”, and “our” mean the Landmark entity identified on your booking confirmation or invoice.

These Booking Terms & Conditions, together with your confirmed itinerary, quotation, invoice, booking form, payment schedule, booking dashboard information, and any other information we bring to your attention before confirming your booking, form the basis of your contract with Landmark for the travel arrangements making up your booking, referred to as your “arrangements”, “experience”, “tour”, or “trip”.

References to “you” and “your” include the named person on the booking and all persons named on the booking, including anyone added or substituted later. The named person on the booking is the lead guest and is responsible for sharing these terms with everyone in the travelling party. By making a booking, the lead guest confirms on behalf of every guest that they have read, understood, and agree to be bound by these terms, and that they:

  • have authority to accept these terms on behalf of all guests listed on the booking;
  • confirm that all guests are at least 18 years old, or that any guest under 18 will travel with and remain under the responsibility of a parent, guardian, or authorised adult;
  • consent to Landmark processing guest information in line with Landmark's privacy policy and the privacy clause in these terms;
  • are responsible for ensuring that all guest names, travel details, dietary requirements, rooming preferences, contact details, and documentation details submitted to Landmark are accurate and kept up to date.

2. Key Terms of Agreement

  • A contract with Landmark comes into force when we issue a written booking confirmation, booking dashboard confirmation, or confirmation invoice after receiving the required deposit or payment.
  • Deposits are non-refundable unless Landmark expressly states otherwise in writing or a refund is required by law.
  • If you cancel your booking, cancellation charges may apply. These charges can increase up to 100% of the trip cost depending on how close to the trip start date the cancellation is made.
  • You may request changes to confirmed arrangements, but changes are not guaranteed and may be subject to availability, supplier approval, administration fees, and additional costs.
  • Landmark may make changes to confirmed arrangements where reasonably necessary, including for safety, supplier availability, operational issues, group size, weather, local conditions, or circumstances beyond our control.
  • Travel insurance is mandatory for all guests unless Landmark expressly confirms in writing that a specific product does not require it.
  • You are responsible for passports, visas, vaccinations, immigration requirements, health formalities, spending money, personal belongings, and compliance with the laws and customs of the destination.

3. Prices, Descriptions, Confirmation and Payment

3.1 Prices

Unless otherwise stated, prices are quoted in United States Dollars (USD) and are per person. Prices may be based on the number of guests, room occupancy, chosen add-ons, date of travel, exchange rates, taxes, local levies, fuel costs, supplier availability, and the package inclusions shown on your booking page or quotation.

Before your booking is confirmed, all prices are subject to availability and may be withdrawn, corrected, or varied without notice. We make reasonable efforts to ensure prices and descriptions are accurate when published. If we become aware of an error before confirming your booking, we will notify you and issue a corrected quote or booking page.

After your booking is confirmed, Landmark may correct obvious pricing errors and may adjust prices where the increase is directly caused by changes outside our control, including taxes, government fees, fuel costs, supplier costs, exchange rates, or changes requested by you. Where a price adjustment is necessary, we will provide a reasonable explanation before collecting the revised amount.

3.2 Descriptions and Itineraries

Trip descriptions, photographs, videos, sample schedules, and marketing materials are intended to give a fair description of the experience. Exact suppliers, menus, activities, timings, vehicles, hotels, hosts, and routes may vary depending on availability, local conditions, safety, weather, traffic, group pace, and supplier operations.

Where a supplier, attraction, restaurant, hotel, guide, venue, or activity becomes unavailable, Landmark may substitute a comparable alternative where reasonably possible. Such substitutions will not automatically entitle you to cancel or receive a refund where the overall character and value of the trip are materially preserved.

3.3 Booking Confirmation

Bookings may be made through Landmark's booking form, website, trip dashboard, reservation portal, invoice, payment link, or directly with a Landmark team member. A booking is not confirmed until we have received the required deposit or payment and issued a written confirmation, dashboard confirmation, or confirmation invoice. When you receive your confirmation, you must review it carefully and inform us immediately if any detail is incorrect. Changes may not be possible later, or may incur fees, supplier charges, or repricing.

3.4 Payment Terms

By booking, you agree to pay the full cost of the trip, including any taxes, local levies, payment processing fees, add-ons, single supplements, late fees, amendment fees, and other charges stated on your booking page, payment schedule, invoice, dashboard, or written confirmation.

Depending on the trip, you may pay in full at the time of booking, or pay a deposit to confirm your place and settle the remaining balance in scheduled instalments by the dates shown in your payment schedule. Deposits are non-refundable except where this document states otherwise or a refund is required by law.

The payment schedule for each trip will be shown at the time of booking. All payments must be made in full by the final payment deadline. If a payment is not received in full and on time, Landmark may suspend work on your booking, release reservations, remove add-ons, reprice the booking, charge late fees, or treat the booking as cancelled by you, in which case the cancellation terms in this document will apply. If any service becomes unavailable, more expensive, or materially different because payment was late, Landmark will not be responsible for resulting changes, losses, or additional charges.

3.5 Payment Methods and Fees

Landmark may accept debit cards, credit cards, bank transfers, payment links, online checkout, third-party processors, or other payment methods stated at the time of booking. You authorise Landmark and its payment processor to collect amounts payable in connection with your booking. If payment is reversed, declined, disputed, charged back, or not received from the payment provider, you remain responsible for paying the outstanding amount immediately on demand.

Payment processing fees, card fees, bank fees, transfer fees, currency conversion fees, and foreign exchange differences are your responsibility unless Landmark states otherwise in writing. Refunds or credits, where applicable, may be reduced by non-refundable payment provider fees, bank charges, and foreign exchange differences.

4. Booking Validity, Amendments and Guest Substitutions

4.1 Quote and Booking Validity

Unless otherwise stated, quotations are valid only for the period shown on the quotation or booking page. If no validity period is shown, the quotation is valid for seven (7) calendar days from the date issued, subject to supplier availability. Where travel is scheduled more than twelve (12) months after the first deposit is paid, rates may be provisional and subject to supplier revalidation.

4.2 Amendments Requested by You

If you wish to change any part of your confirmed arrangements, you must notify Landmark in writing as soon as possible. We have no obligation to make the change, but we will try to assist where reasonably possible. Where we can accommodate a change, it may be subject to availability, administration fees, supplier charges, cancellation charges, payment processing fees, and any price difference. Costs usually increase closer to departure, so requests should be made early.

For custom or private trips, Landmark may allow up to two (2) significant itinerary amendments after the initial deposit has been received. Significant amendments include major date changes, major accommodation changes, major activity changes, a major change in participant numbers, or a substantial change to the agreed route or trip style. Further significant amendments may require a new quote or planning fee.

4.3 Changes in Group Size

Trip prices may be based on a minimum group size, rooming configuration, transport size, shared services, and negotiated supplier rates. If the number of guests changes, the price per person may increase or decrease. A reduction in guest numbers may trigger single supplements, private transport charges, rooming changes, supplier penalties, or itinerary repricing.

4.4 Guest Substitution

If a named guest cannot or does not wish to travel, you may request to transfer that guest's place to another person. The substitute guest must satisfy all conditions applicable to the trip, agree to these Booking Terms & Conditions, provide all required information, and be accepted by Landmark and relevant suppliers. Substitution requests must be made in writing at least thirty (30) days before departure unless Landmark agrees otherwise, and are subject to availability, supplier approval, name-change fees, administration fees, payment processing fees, and any other costs imposed by Landmark or its suppliers. The original and substitute guest are jointly and individually responsible for any outstanding balance and related costs.

5. Cancellations, Refunds and Travel Credits by You

5.1 How to Cancel

Cancellations must be made by the lead guest in writing by email to [email protected]. A cancellation takes effect only when Landmark acknowledges receipt in writing. We aim to issue an updated cancellation statement or invoice within a reasonable time after acknowledging the cancellation.

5.2 Standard Cancellation Charges

Unless your trip-specific booking page, invoice, or contract states a different cancellation policy, the following standard cancellation terms apply. Deposits, payment processing fees, amendment fees, add-on charges already committed to suppliers, and non-recoverable supplier costs are non-refundable at all times.

Eligible instalment payments means amounts paid towards the package price excluding deposits, payment processing fees, amendment fees, late fees, add-ons already committed to suppliers, and non-recoverable supplier charges.

5.3 Travel Credit Terms

Unless Landmark expressly confirms a monetary refund in writing or a monetary refund is required by law, credits issued for guest cancellations will be issued as Landmark travel credit. Travel credits are not cash refunds.

  • Travel credits are tied to the original guest and are non-transferable unless Landmark approves a transfer in writing.
  • Travel credits are valid for twelve (12) months from the original trip start date unless Landmark states a different validity period in writing.
  • Travel credits may be applied only toward a future Landmark experience of equal or greater value, subject to availability.
  • If the future experience costs more than the credit value, the guest must pay the difference.
  • If the future experience costs less than the credit value, the unused balance will not be paid in cash unless Landmark agrees otherwise in writing.
  • Travel credits do not freeze prices. Future bookings are subject to current rates, availability, taxes, fees, exchange rates, supplier terms, and any updated Landmark terms.

5.4 Medical or Health-Related Postponement Requests

If unforeseen medical circumstances affect you or an immediate family member, you may request a postponement. Landmark may, at its discretion and subject to supplier terms, offer a travel credit or allow the booking to be moved to a later date. We may request reasonable supporting documentation. Any postponed or rescheduled trip may be repriced to reflect current supplier rates, taxes, availability, seasonality, exchange rates, and any changes to the itinerary.

5.5 Insurance Claims

If your reason for cancellation is covered by your travel insurance policy, you may be able to reclaim cancellation charges from your insurer. Travel insurance is independent of Landmark. Claims must be made directly with your insurer, and Landmark is not responsible for the outcome of any insurance claim.

6. Changes and Cancellations by Landmark

6.1 Minor Changes

Landmark may make minor changes to your arrangements where necessary, such as changes to activity order, meal venues, departure times, vehicle type, host allocation, photo stops, activity timing, or substitute suppliers where the overall trip experience is not materially affected. We will notify you of minor changes where reasonably possible.

6.2 Significant Changes

Occasionally, Landmark or its suppliers may need to make a significant change before departure, meaning a change that materially affects one of the main characteristics of your trip. Examples include:

  • A change of accommodation or accommodation area for the whole or a significant part of the trip.
  • A change to the overall length of the trip by twelve (12) hours or more.
  • A significant itinerary change that removes one or more main destinations entirely.
  • A confirmed special requirement that Landmark or a supplier can no longer fulfil and that materially affects your arrangements.
  • A required price increase of more than eight percent (8%) of the package price, excluding amendment fees and optional add-ons.

If we need to make a significant change or cancel a trip before departure, we will inform you without undue delay and, where reasonably possible, offer a suitable alternative of comparable standard. Any decision to change, postpone, or cancel a trip will be made with regard to safety, operational feasibility, supplier availability, local conditions, and the best interests of the group.

6.3 Minimum Numbers

Some group trips may require a minimum number of guests to operate at the advertised price or at all. If the minimum is not reached, Landmark may cancel, reprice, or modify the trip. Where Landmark cancels solely because minimum numbers are not reached, Landmark will offer a suitable alternative, travel credit, or a refund of amounts paid to Landmark, less non-refundable payment processing fees and any supplier costs already committed with your knowledge or approval.

6.4 Cancellation by Landmark

If Landmark cancels a trip for reasons within Landmark's reasonable control and no suitable alternative is accepted by you, Landmark will refund eligible amounts paid to Landmark within a reasonable time, subject to receiving refunds from suppliers where supplier funds have already been paid out. Landmark will not be responsible for incidental expenses you incur in preparation for travel, including flights, visas, vaccinations, travel insurance, clothing, equipment, airport transfers not booked through Landmark, or lost work time.

6.5 Changes After Departure

If, after departure, Landmark or a supplier becomes unable to provide a significant part of your confirmed arrangements, Landmark will try to provide suitable alternative arrangements of equal or higher quality where reasonably possible. If only a lower-cost alternative is available, Landmark may provide an appropriate adjustment where we receive a refund or credit from the relevant supplier.

7. Passports, Visas, Health Requirements and Travel Documents

You are responsible for checking and fulfilling all passport, visa, health, vaccination, immigration, entry, transit, and travel documentation requirements applicable to your itinerary. Landmark may provide general guidance, but requirements can change and may depend on nationality, passport type, transit routes, vaccination status, residency, prior travel history, and individual circumstances.

You must check requirements with the relevant embassy, consulate, immigration authority, airline, doctor, travel clinic, or official government source in good time before departure, and ensure all required documents are valid and in your possession before travel. Landmark is not responsible if you cannot travel, are refused entry, miss a service, incur additional costs, or suffer loss because you failed to comply with these requirements. You agree to reimburse Landmark for any fines, charges, losses, or expenses Landmark incurs as a result. Cancellation or disruption caused by passport, visa, immigration, health, vaccination, or documentation issues will be treated as cancellation by you and the cancellation terms will apply.

8. Accommodation, Rooming and Occupancy

Accommodation arranged by Landmark may only be used by the people named on the booking confirmation or the latest amended confirmation. You must not allow any unauthorised person to occupy a room, use hotel facilities as part of your booking, or join the trip without Landmark's written approval.

Room types, bedding requests, floor preferences, adjoining rooms, views, early check-in, late check-out, and other accommodation preferences are subject to hotel availability and cannot be guaranteed unless Landmark expressly confirms them in writing. “Double occupancy” generally means two guests sharing one room; it does not guarantee two separate beds unless the booking specifically confirms twin beds or the hotel confirms the bed configuration. Guests are responsible for incidental hotel charges, minibar, room service, laundry, telephone charges, damage, lost keys, smoking fees, resort fees not included in the package, and any other personal expenses charged to their room.

9. Our Responsibility to You

Landmark will exercise reasonable skill, care, professionalism, and due diligence in planning, coordinating, and delivering the services described in your confirmed itinerary, and will make reasonable efforts to deliver the trip as advertised or as otherwise confirmed to you in writing.

Many trip components are delivered by independent suppliers, including hotels, restaurants, transport providers, guides, venues, attractions, activity providers, photographers, airlines, ferries, event organisers, and local vendors. Landmark is not responsible for the acts, omissions, delays, failures, negligence, or default of independent suppliers except where applicable law provides otherwise or where Landmark has failed to exercise reasonable care in selecting or coordinating the supplier. Unless specifically included in your Landmark package, international flights, domestic flights, visas, travel insurance, vaccinations, passport fees, personal expenses, optional activities, and services not listed as included are not part of your Landmark booking.

10. Activity Risk, Accident Waiver and Release of Liability

By booking and participating in a Landmark trip, you acknowledge that travel and destination activities carry inherent risks. These may include, but are not limited to, road travel, walking tours, boat rides, beaches, waterfalls, nightlife, crowds, uneven terrain, heat, weather, wildlife, food allergies, physical exertion, water activities, remote areas, equipment failure, medical limitations, actions of other guests, actions of third parties, and local conditions.

You confirm that you are physically and medically fit to travel and participate in the activities you choose to join, and that you have not been advised by a qualified medical professional not to participate. You are responsible for assessing your own abilities, limitations, and comfort level before joining any activity.

To the fullest extent permitted by law, you waive, release, and discharge Landmark, its owners, directors, employees, contractors, representatives, hosts, partners, and agents from liability for death, personal injury, illness, property damage, theft, loss, delay, or expense arising from inherent travel risks, your own acts or omissions, the acts or omissions of third parties, or circumstances outside Landmark's reasonable control. Nothing in these terms excludes liability that cannot legally be excluded under applicable law. You consent to receive emergency medical assistance or treatment that may be considered advisable in the event of injury, accident, or illness during the trip, and remain responsible for all medical, evacuation, transport, hospital, pharmacy, and related costs unless covered by your travel insurance or a third party.

11. Limitation of Liability

Landmark is not liable for losses that were not reasonably foreseeable at the time of booking, losses caused by you, losses caused by third parties unconnected with the provision of your arrangements, or losses caused by unavoidable and extraordinary circumstances beyond Landmark's control.

To the fullest extent permitted by law, Landmark's maximum liability to any individual guest under or in connection with these Booking Terms & Conditions is limited to the total amount paid by that guest to Landmark for the affected booking, excluding payment processing fees, insurance, flights, visas, personal expenses, and services not supplied by Landmark.

12. Luggage, Personal Possessions and Money

You are responsible for the safety and security of your luggage, money, documents, electronics, jewellery, cards, medication, and personal possessions at all times. Landmark is not responsible for loss, theft, or damage to luggage, personal possessions, or money unless directly caused by Landmark's proven negligence and only to the extent required by law. We strongly recommend that valuables are kept secure, unnecessary valuables are left at home, and travel insurance is purchased to cover luggage, money, personal possessions, documents, theft, loss, and damage.

13. Force Majeure, Public Health Disruption and Delay

13.1 Force Majeure

Except where otherwise expressly stated, Landmark will not be liable, provide a price reduction, or pay compensation if Landmark's contractual obligations are affected by unavoidable and extraordinary circumstances beyond Landmark's control or beyond the control of the relevant supplier, even if all reasonable measures had been taken. Examples include war, threat of war, civil unrest, terrorism, riot, government action, border closures, visa restrictions, airport closures, airline disruption, industrial disputes, strikes, fire, flood, natural disaster, extreme weather, epidemic, pandemic, public health emergency, disease outbreak, chemical or biological incident, power failure, supplier insolvency, transport disruption, road closure, sea or river conditions, and safety threats.

13.2 Public Health Disruption

If a trip cannot reasonably operate due to a public health disruption, border restriction, government order, airport closure, mandatory quarantine, or similar event that makes the whole trip impossible or unsafe, Landmark may offer postponement, a revised itinerary, or travel credit. Any postponed or revised trip may be subject to additional charges caused by supplier rates, fuel costs, taxes, exchange rates, availability, or changes to the package.

13.3 Delay

Landmark is not liable for delays caused by force majeure, airlines, airports, border authorities, traffic, weather, transport providers, guest lateness, road conditions, security checks, ferry schedules, event organisers, or other third parties. A delay or cancellation of your flight or transport service does not automatically entitle you to cancel other Landmark arrangements. You should contact your travel insurer for any applicable delay or disruption claim.

14. Guest Conduct and Behaviour

You must behave responsibly and respectfully toward fellow guests, Landmark staff, suppliers, local communities, guides, drivers, hotel staff, venue staff, and members of the public. You must comply with local laws, cultural norms, safety instructions, hotel rules, supplier rules, and reasonable directions given by Landmark or any person in authority.

Landmark may terminate your participation immediately if, in Landmark's opinion or the opinion of any person in authority, your behaviour or the behaviour of any member of your party causes or is likely to cause danger, distress, harassment, intimidation, offence, property damage, disruption, delay, reputational harm, or legal risk. Examples of unacceptable behaviour include violence, threats, harassment, discriminatory conduct, excessive intoxication, illegal drug use, sexual misconduct, theft, non-payment of personal charges, repeated lateness, refusal to follow safety instructions, or behaviour that disrupts the group or suppliers.

If your participation is terminated, Landmark's obligations to you will cease immediately. You may be required to leave the accommodation, vehicle, activity, venue, or trip at your own cost. No refund or travel credit will be provided for lost services, and Landmark will not be responsible for any expenses you incur as a result. You and your party will be jointly and individually responsible for any loss, damage, fines, supplier charges, or expenses caused by your conduct.

15. Disabilities, Medical Conditions and Special Requests

Landmark aims to be as helpful as reasonably possible with accessibility needs, medical requirements, dietary needs, and special requests. If you or any member of your party has a disability, reduced mobility, medical condition, allergy, pregnancy, dietary requirement, accessibility need, or other requirement that may affect the trip, you must provide full details before booking or as soon as you become aware of the need.

We can provide general information about whether arrangements are likely to be suitable, but we can only assess suitability based on the information you provide. Some destinations, activities, vehicles, hotels, restaurants, heritage sites, beaches, boats, and local environments may not be fully accessible. Special requests are not guaranteed unless Landmark confirms them in writing. If we or a supplier reasonably believe that we cannot safely or appropriately accommodate a requirement, we may decline the booking, refuse participation in a specific activity, suggest an alternative, or cancel the affected guest's participation subject to applicable cancellation charges. Guests are responsible for the cost of any special medical, accessibility, mobility, dietary, transport, accommodation, or related arrangements needed before or during the trip unless Landmark expressly agrees otherwise in writing.

16. Travel Insurance

It is a mandatory condition of booking that every guest obtains appropriate travel insurance for the full duration of the trip. Your policy should include, at minimum, cancellation cover, medical expenses, emergency assistance, personal accident, repatriation, travel delay, missed departure, baggage, personal possessions, and activities included in your itinerary.

Travel insurance does not form part of your contract with Landmark and is not included in the package unless expressly stated. If you travel without adequate insurance, Landmark will not be liable for losses that would otherwise have been covered by insurance. You must carry proof of insurance and provide it to Landmark if reasonably requested.

17. Complaints

If you experience a problem during your trip, you must report it immediately to your Landmark host, trip contact, or emergency contact so that reasonable efforts can be made to resolve it during the trip. If you do not report the issue at the time, Landmark may have limited ability to investigate or correct it later.

If a problem is not resolved during the trip and you wish to make a formal complaint, you must send full written details to [email protected]within twenty-eight (28) days of your return. Failure to report the issue during the trip and follow up in writing within this period may reduce or remove any right to compensation where Landmark's ability to investigate or resolve the matter has been prejudiced.

18. Privacy and Marketing Content

18.1 Privacy

Information provided by you in connection with your booking will be collected, stored, used, and shared where necessary to process your booking, operate the trip, communicate with you, arrange supplier services, meet legal obligations, manage safety, and provide customer support. Landmark will handle personal information in accordance with its privacy policy.

18.2 Photography, Video and Marketing Content

During Landmark trips, photographs, videos, testimonials, or other content may be captured by Landmark, its team, content creators, suppliers, or fellow guests. By joining the trip, you agree that Landmark may use photographs, videos, or content in which you appear for marketing, social media, website, advertising, recap, portfolio, and promotional purposes without additional payment. If you do not wish to be intentionally photographed or filmed for Landmark marketing, you must notify us in writing before the trip begins. We will make reasonable efforts to respect your request, but we cannot guarantee that you will not appear incidentally in group scenes, public places, event footage, crowd shots, or content captured by third parties or other guests.

19. Governing Law, Dispute Resolution and Jurisdiction

These Booking Terms & Conditions and any dispute, claim, or matter arising out of or in connection with them, your booking, or your trip are governed by the laws of the Republic of Ghana.

If a dispute arises, the parties will first consult and negotiate in good faith with the aim of reaching a reasonable resolution. If the parties do not resolve the dispute within thirty (30) days after negotiations begin, either party may refer the matter to the courts of the Republic of Ghana. Unless otherwise required by law, the courts of Ghana will have jurisdiction over disputes arising from or connected with these Booking Terms & Conditions.

20. General Provisions

20.1 Third Party Rights

No person other than a party to this agreement, their lawful successors, and permitted assignees has the right to enforce any term of this agreement.

20.2 Entire Agreement

These Booking Terms & Conditions, together with the confirmed itinerary, booking page, invoice, payment schedule, dashboard terms, proposal, and any written trip-specific terms issued by Landmark, form the entire agreement between you and Landmark in relation to your booking.

20.3 Severability

If any part of these terms is found to be invalid, illegal, or unenforceable, the remaining parts will continue in full force and effect.

20.4 Updates to Terms

Landmark may update these Booking Terms & Conditions from time to time. The version that applies to your booking is the version provided to you or made available at the time your booking is confirmed, unless a later version is expressly accepted by you in writing or is required by law.

Acceptance

By paying a deposit, completing a booking form, accepting a proposal, using the Landmark booking dashboard, or otherwise confirming a booking, the lead guest confirms that they have read, understood, and agree to these Booking Terms & Conditions on behalf of all guests listed on the booking.
